These General Terms and Conditions of Sale govern the purchase of products made through the website www.tomaino.it, owned by Tomaino Srl.
Placing an order implies full acceptance of these conditions. If the user does not intend to accept them, they are asked not to make purchases through the site.

2. Scope of Application
These conditions apply to all sales made through the Tomaino.it website to end consumers as per Legislative Decree 206/2005 (Consumer Code).
Unauthorized use of the site for professional or commercial purposes is prohibited.
3. Products and Availability
The essential characteristics of the products are described in their respective product sheets. Images are for illustrative purposes only and may not perfectly represent the actual product.
Product availability is updated automatically, but it is not guaranteed in real time. In case of unavailability after the order, the customer will be promptly informed and refunded.
4. Prices
All prices are expressed in Euro and include VAT, unless otherwise indicated. Shipping costs are indicated separately before order confirmation.
Tomaino Srl reserves the right to change prices at any time, it being understood that the price displayed at the time of the order will be applied to the customer.
5. Obvious Errors
In case of an obvious or recognizable error in price, description, or availability, Tomaino Srl reserves the right to cancel the order, even after confirmation, by fully refunding any amounts paid.
6. Purchase Method
The order is considered concluded only upon sending the order confirmation via email. The user's submission of the order constitutes a contractual proposal.
Tomaino Srl reserves the right to refuse incomplete, anomalous, suspicious orders, or orders from users who have previously violated the terms of sale.
7. Payment Methods
The payment methods indicated on the site at the time of purchase are accepted. Payments are managed through certified providers.
Tomaino Srl does not store or have access to full payment instrument data.
8. Shipping and Delivery
Shipments are made via selected couriers. The indicated delivery times are to be considered indicative and not binding.
Any delays due to force majeure, periods of high demand, holidays, or strikes cannot be attributed to Tomaino Srl.
9. Customer's Obligations Upon Delivery
Upon delivery, the customer is required to check:
- the integrity of the packaging;
- the correspondence of the number of packages;
- the absence of obvious damage.
Any anomalies must be reported immediately to the courier and to Tomaino Srl within 24 hours.
10. Limitation of Liability
Tomaino Srl is not responsible for indirect damages, loss of profit, or improper use of products.
Liability is in any case limited to the value of the order placed, except in cases of willful misconduct or gross negligence.
11. Suspension or Cancellation of Service
Tomaino Srl reserves the right to temporarily or definitively suspend access to the site in case of:
- illegal or fraudulent use;
- violation of these conditions;
- attempts to abuse the return or payment system.
12. Official Communications
All official communications will be made via emails sent from addresses traceable to Tomaino.it.
13. Applicable Law and Competent Court
The sales contract is governed by Italian law. For any dispute, the court of the consumer's place of residence or domicile, as provided by current legislation, shall have jurisdiction.
